1. Amaç ve Kapsam
İşbu Kullanım Koşulları ("Kullanım Koşulları"), UNIONION (Merve Alpay Erengül şahıs işletmesi) ("UNIONION", "Şirket", "biz", "bize" veya "bizim") tarafından sunulan mobil uygulama, internet sitesi, yazılım, dijital hizmetler ve bunlarla bağlantılı tüm özelliklerin (birlikte "Platform") kullanımına ilişkin hüküm ve koşulları düzenlemektedir.
Platform'a erişen, Platform'u kullanan, Platform üzerinde hesap oluşturan veya Platform aracılığıyla sunulan herhangi bir hizmetten yararlanan gerçek kişiler ("Kullanıcı", “siz”) işbu Kullanım Koşulları ile bağlıdır.
Platform'un kullanımı, Kullanıcı ile UNIONION arasında hukuken bağlayıcı bir sözleşme ilişkisi kurulmasına neden olur.
Platform'a erişmeden veya Platform'u kullanmadan önce işbu Kullanım Koşulları'nın dikkatlice okunması gerekmektedir.
Platform üzerinde zaman zaman yayımlanabilecek diğer politika ve kuralları
okuduğunuz, anladığınız ve bunlarla bağlı olmayı kabul ettiğiniz anlamına gelir.
İşbu Kullanım Koşulları'nı kabul etmiyorsanız Platform'u kullanmamalısınız.
2. Tanımlar
İşbu Kullanım Koşulları'nda aşağıdaki ifadeler karşılarında belirtilen anlamları taşır.
Hesap, Kullanıcının Platform hizmetlerinden yararlanabilmesi amacıyla oluşturduğu kişisel kullanıcı hesabını ifade eder.
İçerik, metin, mesaj, fotoğraf, video, ses kaydı, biyografi, kullanıcı adı, emoji, görsel, yorum, beğeni, paylaşım, profil bilgileri ile Platform üzerinde oluşturulan veya paylaşılan her türlü dijital veriyi ifade eder.
Kullanıcı İçeriği, Kullanıcı tarafından Platform'a yüklenen, oluşturulan, gönderilen, paylaşılan veya Platform aracılığıyla iletilen her türlü İçeriği ifade eder.
Hizmetler, Platform üzerinden sunulan mevcut veya ileride sunulacak tüm ücretsiz veya ücretli ürün, özellik, abonelik, algoritma, eşleştirme sistemi, iletişim araçları, yapay zekâ destekli özellikler ve diğer dijital hizmetleri ifade eder.
Premium Hizmetler, ücret karşılığında sunulan abonelikleri, dijital ürünleri ve diğer ücretli hizmetleri ifade eder.
Topluluk Kuralları, Platform üzerindeki davranış standartlarını ve yasaklanan faaliyetleri düzenleyen kuralları ifade eder.
Gizlilik Politikası, kişisel verilerin işlenmesine ilişkin esasları açıklayan politika metnini ifade eder.
Uygulanabilir Mevzuat, Platform'un faaliyet gösterdiği ülkelerde yürürlükte bulunan tüm kanunları, yönetmelikleri, düzenleyici işlemleri, mahkeme kararlarını ve bağlayıcı idari kararları ifade eder.
3. Kullanım Koşullarının Kabulü
Platform'a erişmeniz, hesap oluşturmanız veya Platform'u herhangi bir şekilde kullanmanız halinde işbu Kullanım Koşulları'nın sizin açınızdan bağlayıcı olduğunu kabul etmiş sayılırsınız.
Platform üzerinden belirli hizmetlerin kullanılabilmesi için ek sözleşmeler, onay metinleri veya özel kullanım koşullarının kabul edilmesi gerekebilir. Böyle bir durumda ilgili hizmet bakımından özel düzenlemeler öncelikli olarak uygulanacaktır.
Platform'un belirli bölümlerinin kullanılabilmesi için cihaz üreticileri, uygulama mağazaları, ödeme hizmeti sağlayıcıları veya üçüncü taraf hizmet sağlayıcılarının kendi kullanım koşullarının da uygulanması mümkündür. Kullanıcı, bu üçüncü taraf hizmetlerinden yararlanması halinde ilgili üçüncü tarafların kullanım koşullarına da tabi olacağını kabul eder.
4. Platformun Niteliği
UNIONION, kullanıcıların birbirleriyle iletişim kurmasına, etkileşimde bulunmasına ve Platform'un sunduğu özelliklerden yararlanmasına imkân sağlayan dijital bir teknoloji platformudur.
UNIONION; herhangi bir kullanıcı adına hareket etmez, kullanıcılar arasında temsilci, vekil, aracı veya garantör sıfatıyla hareket etmez, kullanıcılar arasında kurulabilecek herhangi bir arkadaşlık, sosyal ilişki, romantik ilişki, ticari ilişki veya diğer herhangi bir ilişkinin tarafı değildir.
Platform, kullanıcıların birbirleriyle tanışmasına ve iletişim kurmasına teknik altyapı sağlamaktadır.
Platform'da yer alan kullanıcıların beklentilerinizi karşılayacağını
garanti etmez.
Platform üzerinden gerçekleştirilen tüm iletişimler ve Platform dışında gerçekleşen tüm görüşmeler, buluşmalar, işlemler ve diğer etkileşimler münhasıran ilgili kullanıcıların sorumluluğundadır.
5. Platforma Erişim ve Uygunluk
Platform yalnızca yürürlükteki hukuka göre bağlayıcı sözleşme kurma ehliyetine sahip gerçek kişiler tarafından kullanılabilir.
Aksi açıkça belirtilmedikçe Platform'u kullanabilmek için en az on sekiz (18) yaşında olmanız gerekmektedir.
e) işbu Kullanım Koşulları'nı ihlal etmeyeceğinizi
beyan ve taahhüt etmiş olursunuz.
UNIONION, uygunluk şartlarının karşılanmadığını tespit etmesi veya bu konuda makul şüphe oluşması halinde, herhangi bir tazminat yükümlülüğü doğmaksızın Hesabı askıya alabilir, doğrulama talep edebilir veya Hesabı kalıcı olarak kapatabilir.
6. Kullanım Koşullarında Değişiklik
UNIONION, işbu Kullanım Koşulları'nı zaman zaman güncelleyebilir. Esaslı değişiklikler yürürlüğe girmeden önce, teknik olarak mümkün olduğu ölçüde, Platform üzerinden veya kayıtlı iletişim bilgileri aracılığıyla Kullanıcılara bildirilir.
Değişikliklerin yürürlüğe girmesinden sonra Platform'un kullanılmaya devam edilmesi, güncellenen Kullanım Koşulları'nın kabul edildiği anlamına gelir.
Kullanıcı'nın değişiklikleri kabul etmemesi halinde Platform'u kullanmayı durdurması ve dilerse hesabını kapatması gerekir.
7. Hesap Oluşturulması
Platform'un belirli özelliklerinden yararlanabilmek için Kullanıcının bir Hesap oluşturması gerekmektedir.
Kullanıcı, hesap oluştururken kendisinden talep edilen bilgileri doğru, eksiksiz ve güncel olarak sağlamakla yükümlüdür. Kullanıcı; yanlış, yanıltıcı, güncelliğini yitirmiş, üçüncü kişilere ait, sahte veya gerçeği yansıtmayan bilgiler kullanarak Hesap oluşturmayacağını kabul ve taahhüt eder.
UNIONION, sağlanan bilgilerin doğruluğunu her zaman doğrulamakla yükümlü değildir. Bununla birlikte UNIONION, gerekli gördüğü hâllerde Kullanıcıdan ek bilgi veya belge talep edebilir ya da çeşitli doğrulama yöntemleri uygulayabilir.
Kullanıcı, talep edilen doğrulama süreçlerine makul süre içerisinde katılmaması hâlinde Platform hizmetlerinin tamamına veya bir kısmına erişiminin sınırlandırılabileceğini kabul eder.
8. Hesap Güvenliği
Kullanıcı, Hesabına ilişkin kullanıcı adı, parola, doğrulama kodları ve diğer güvenlik bilgilerinin gizliliğini korumaktan münhasıran sorumludur.
Hesabına yetkisiz erişim şüphesi oluşması hâlinde durumu derhâl UNIONION'a bildireceğini
kabul eder.
Kullanıcının Hesabı üzerinden gerçekleştirilen işlemler, aksi açıkça ispat edilmedikçe Kullanıcı tarafından gerçekleştirilmiş kabul edilir.
UNIONION, Kullanıcının güvenlik yükümlülüklerini ihlal etmesinden kaynaklanan zarar, veri kaybı veya yetkisiz kullanımlardan sorumlu değildir.
9. Tek Hesap İlkesi
Aksi UNIONION tarafından açıkça izin verilmedikçe her gerçek kişi yalnızca bir (1) aktif Hesaba sahip olabilir.
UNIONION; aynı kişiye ait olduğu değerlendirilen, aynı kimlik bilgilerini kullanan, aynı iletişim bilgileri ile oluşturulan, aynı cihaz veya teknik göstergeler üzerinden yönetildiği makul şekilde tespit edilen birden fazla Hesabı inceleyebilir, birleştirebilir, askıya alabilir veya kalıcı olarak kapatabilir.
Bu hüküm, kötüye kullanımın önlenmesi, Platform güvenliğinin sağlanması ve diğer Kullanıcıların korunması amacıyla uygulanmaktadır.
10. Kimlik ve Profil Doğrulaması
UNIONION, Platform güvenliğini artırmak amacıyla çeşitli doğrulama yöntemleri uygulayabilir.
Bu doğrulamalar; e-posta doğrulaması, mobil telefon doğrulaması, yapay zekâ destekli sahte profil tespiti, üçüncü taraf doğrulama hizmetleri ile veya bunlarla sınırlı olmaksızın benzeri yöntemlerle gerçekleştirilebilir.
Doğrulama yapılması, herhangi bir Kullanıcının kimliğinin, güvenilirliğinin, niyetinin, davranışlarının veya Platform dışında gerçekleştireceği eylemlerin UNIONION tarafından garanti edildiği anlamına gelmez.
Doğrulanmış hesap rozeti veya benzeri işaretler yalnızca ilgili doğrulama sürecinin başarıyla tamamlandığını gösterir.
UNIONION, herhangi bir doğrulama yöntemini uygulama, kaldırma, değiştirme veya belirli Kullanıcı grupları için zorunlu hâle getirme hakkını saklı tutar.
11. Profil Bilgileri
Kullanıcı, profilinde paylaştığı tüm bilgilerin doğru ve güncel olmasını sağlamakla yükümlüdür.
Kullanıcı; başka bir kişiyi taklit edemez, üçüncü kişilere ait fotoğrafları izinsiz kullanamaz, yanıltıcı kimlik bilgileri oluşturamaz, gerçek dışı unvanlar veya doğrulanmamış sıfatlar kullanarak diğer Kullanıcıları yanıltamaz.
Profil fotoğrafları, biyografi, kullanıcı adı ve diğer profil unsurları işbu Kullanım Koşulları ile Topluluk Kuralları'na uygun olmalıdır.
UNIONION, uygun olmadığını değerlendirdiği profil bilgilerinin düzeltilmesini talep edebilir, görünürlüğünü sınırlandırabilir veya kaldırabilir.
12. Hesabın Devri ve Kullanımı
Hesap kişiye özeldir. Kullanıcı; Hesabını satamaz, kiralayamaz, devredemez, lisanslayamaz, başkasının kullanımına bırakamaz, herhangi bir ticari amaçla kullandıramaz.
UNIONION'un önceden yazılı onayı bulunmadıkça Hesabın devrine yönelik her türlü işlem hükümsüzdür.
13. Hesabın Askıya Alınması ve Kapatılması
UNIONION; (i) işbu Kullanım Koşulları'nın, (ii) Topluluk Kuralları'nın, (iii) Uygulanabilir Mevzuat'ın, ihlâl edildiğini makul şekilde değerlendirmesi hâlinde veya Platform'un güvenliği, diğer Kullanıcıların korunması ya da hukuki yükümlülüklerin yerine getirilmesi amacıyla gerekli görmesi durumunda, önceden bildirimde bulunmaksızın veya mümkün olduğu ölçüde bildirimde bulunarak;
Platform'a yeniden kayıt oluşturulmasını engelleyebilir.
UNIONION, her olayın özelliklerini dikkate alarak ihlalin niteliğine uygun tedbirleri uygulama konusunda takdir yetkisine sahiptir.
14. Hesabın Kullanıcı Tarafından Kapatılması
Kullanıcı, dilediği zaman Hesabını Platform üzerinden veya UNIONION tarafından sunulan diğer yöntemlerle kapatabilir.
Hesabın kapatılması; yürürlükteki mevzuattan doğan yükümlülükleri, devam eden aboneliklere ilişkin hükümleri, fikri mülkiyet lisanslarını, uyuşmazlık çözüm hükümlerini, sorumluluğun sınırlandırılmasına ilişkin düzenlemeleri kendiliğinden ortadan kaldırmaz.
UNIONION, yürürlükteki mevzuattan kaynaklanan saklama yükümlülükleri veya meşru menfaatleri kapsamında belirli bilgi ve kayıtları ilgili mevzuatın izin verdiği süre boyunca muhafaza edebilir.
15. Platformun Kullanımı
Kullanıcı, Platform'u yalnızca hukuka uygun amaçlarla ve işbu Kullanım Koşulları, Topluluk Kuralları ile Uygulanabilir Mevzuat'a uygun şekilde kullanacağını kabul eder.
Platform'un amacı, kullanıcıların birbirleriyle iletişim kurmalarına, etkileşimde bulunmalarına ve Platform tarafından sunulan özelliklerden yararlanmalarına imkân sağlamaktır.
Platform, hukuka aykırı faaliyetlerde bulunmak, üçüncü kişilere zarar vermek, diğer kullanıcıları rahatsız etmek veya Platform'un güvenliğini tehlikeye düşürmek amacıyla kullanılamaz.
Kullanıcı, Platform'u dürüstlük kuralına uygun, diğer kullanıcıların haklarına saygılı ve iyi niyetli şekilde kullanacağını kabul eder.
16. Kullanıcının Genel Yükümlülükleri
Kullanıcı, Platform'u kullanırken; (i) yürürlükte bulunan tüm mevzuata, (ii) işbu Kullanım Koşulları'na, (iii) Topluluk Kuralları'na, (iv) üçüncü kişilerin haklarına, uygun davranacağını kabul ve taahhüt eder.
Platform üzerinden gerçekleştirdiği her türlü işlem ve faaliyetten
münhasıran kendisi sorumludur.
17. Yasaklanan Davranışlar
Kullanıcı aşağıda sayılan davranışlarda bulunmayacağını kabul eder.
17.1 Kimlik ve Güven İhlalleri
başkasına ait hesapları kullanamaz.
17.2 Hukuka Aykırı Faaliyetler
yürürlükteki mevzuatı ihlal eden herhangi bir faaliyeti yürütmek
amacıyla kullanılamaz.
17.3 Taciz ve Zararlı Davranışlar
psikolojik baskı oluşturan
davranışlarda bulunamaz.
Bir kullanıcının açıkça iletişimi sonlandırdığı veya istemediğini belirttiği hâllerde iletişim kurmaya devam edilmesi de bu madde kapsamında değerlendirilebilir.
17.4 Aldatıcı ve Manipülatif Davranışlar
kullanıcıları Platform dışındaki dolandırıcılık faaliyetlerine yönlendiremez.
17.5 Ticari Kullanım
UNIONION'un açık yazılı izni bulunmadıkça Platform; reklam yapmak, müşteri kazanmak, ticari tanıtım yapmak, ürün veya hizmet satmak, sponsorluk yürütmek, ticari kampanya düzenlemek, takipçi toplamak, trafik yönlendirmek amacıyla kullanılamaz.
17.6 Platform Güvenliğine Yönelik Faaliyetler
Kullanıcı; Platform'un güvenlik önlemlerini aşmaya çalışamaz, kaynak koduna erişmeye çalışamaz, tersine mühendislik yapamaz, otomatik veri çekemez, bot, crawler, scraper veya benzeri araçlar kullanamaz, Platform'un normal çalışmasını engelleyemez, zararlı yazılım yükleyemez, güvenlik açıklarından yararlanamaz, hizmet engelleme (DoS/DDoS) niteliğinde faaliyetlerde bulunamaz.
17.7 Otomatik Kullanım
UNIONION'un açık yazılı izni bulunmadıkça; yapay zekâ ajanları, otomasyon yazılımları, bot hesaplar, otomatik mesaj gönderim sistemleri, otomatik profil oluşturma sistemleri Platform üzerinde kullanılamaz.
18. Kullanıcılar Arasındaki İletişimler ve Etkileşimler
Platform üzerinde kurulan iletişim münhasıran ilgili kullanıcılar arasında gerçekleşmektedir.
UNIONION; kullanıcıların beyanlarının doğruluğunu, kullanıcıların gerçek kimliklerini, niyetlerini, güvenilirliklerini, davranışlarını, Platform dışında gerçekleştirecekleri eylemleri garanti etmez.
Kullanıcılar, özellikleri ve fonksiyonları zaman zaman UNIONION’ın takdirine bağlı olarak değişebilecek ve güncellenebilecek olan direkt mesajlaşma (DM) kanalıyla birbirleri ile iletişime ve etkileşime geçebilecektir. Direkt mesajlar da işbu Kullanım Koşulları ve UNIONION tarafından kabul edilen çeşitli politika ve prosedürlere tabidir. Kullanıcılar, Topluluk Kuralları başta olmak üzere UNIONION tarafından benimsenen davranış ve etik kurallarına uygun davranmakla yükümlüdür. Direkt mesajlaşma üzerinden gönderilen ögeler de birer İçerik sayılmaktadır ve İçerikler’e özgü kurallara tabidir.
Kullanıcı, Platform dışında gerçekleştireceği her türlü görüşme, buluşma veya diğer etkileşimlerde gerekli özeni göstermekle yükümlüdür.
UNIONION, kullanıcılar arasında Platform dışında gerçekleşen olaylardan sorumlu değildir.
19. Raporlama ve Moderasyon
Platform güvenliğinin sağlanabilmesi amacıyla Kullanıcılar, diğer kullanıcıları veya İçerikleri Platform üzerinden raporlayabilir.
UNIONION; raporları inceleyebilir, ek bilgi talep edebilir, İçerikleri inceleyebilir ve değerlendirebilir, hesapları incelemeye alabilir, gerekli gördüğü tedbirleri uygulayabilir.
UNIONION'un moderasyon faaliyetleri, Platform'un güvenliğini artırmaya yönelik olup; Platform üzerinde yer alan her İçeriğin önceden incelendiği veya sürekli olarak denetlendiği anlamına gelmez.
Hiçbir raporlama sistemi veya moderasyon süreci, Platform üzerinde hukuka aykırı veya istenmeyen davranışların tamamen önleneceği yönünde bir garanti oluşturmaz.
20. Topluluk Kuralları
Platform'un güvenli ve saygılı bir ortam olarak sürdürülebilmesi amacıyla Kullanıcılar, işbu Kullanım Koşulları'nın yanı sıra Topluluk Kuralları'na da uymakla yükümlüdür.
Topluluk Kuralları, Platform'da kabul edilebilir davranış standartlarını açıklamakta olup, Kullanım Koşulları'nın ayrılmaz bir parçasını oluşturur.
yeniden kayıt oluşturulmasının engellenmesi
dâhil olmak üzere uygun yaptırımların uygulanmasına neden olabilir.
UNIONION, ihlalin niteliği, ağırlığı, tekrar edip etmediği ve diğer kullanıcılar üzerindeki etkisini dikkate alarak uygulanacak yaptırımı belirleme konusunda takdir yetkisine sahiptir.
21. Kullanıcı İçerikleri
Platform, Kullanıcıların profil bilgileri oluşturmasına, fotoğraf yüklemesine, mesaj göndermesine, yorum paylaşmasına ve diğer Kullanıcılarla çeşitli şekillerde etkileşim kurmasına olanak sağlayabilir.
Platform'a yüklenen, oluşturulan, gönderilen, paylaşılan veya Platform aracılığıyla iletilen her türlü İçerik, aksi açıkça belirtilmedikçe Kullanıcı İçeriği olarak kabul edilir.
Kullanıcı, Platform'a yüklediği her türlü Kullanıcı İçeriğinden münhasıran kendisinin sorumlu olduğunu kabul eder.
UNIONION, Kullanıcı İçeriklerinin doğruluğunu, hukuka uygunluğunu, güncelliğini veya güvenilirliğini garanti etmez.
22. Kullanıcı Beyan ve Taahhütleri
Platform'a yüklenen İçeriğin işbu Kullanım Koşulları ile Topluluk Kuralları'na uygun olduğunu
beyan ve taahhüt eder.
Kullanıcı, üçüncü kişilere ait fotoğraf, video, ses kaydı veya diğer içerikleri gerekli izinler olmaksızın Platform'a yüklemeyeceğini kabul eder.
23. Kullanıcı İçeriğine İlişkin Lisans
Kullanıcı, Kullanıcı İçeriği üzerindeki mülkiyet hakkını muhafaza eder.
Ancak Kullanıcı, Platform'un işletilebilmesi ve Hizmetlerin sunulabilmesi amacıyla, Platform'a yüklediği Kullanıcı İçeriği bakımından UNIONION'a; dünya genelinde geçerli, münhasır olmayan, devredilebilir, alt lisans verilebilir, telifsiz, Platform'un işletilmesi süresince geçerli bir kullanım lisansı vermektedir.
Bu lisans, yalnızca aşağıdaki faaliyetlerin yerine getirilebilmesi amacıyla kullanılabilir:
Platform'un teknik işleyişi bakımından gerekli diğer işlemlerin gerçekleştirilmesi.
Bu lisans, Kullanıcı İçeriğinin reklam, pazarlama veya Platform dışında ticari amaçlarla kullanılması yönünde bir yetki vermez; bu tür kullanımlar ancak Kullanıcının ayrıca ve açıkça vereceği izin kapsamında gerçekleştirilebilir.
Kullanıcı, hesabını silmesi veya İçeriğini kaldırması sonrasında, teknik yedekleme sistemleri, hukuki yükümlülükler ve makul veri saklama süreçleri kapsamında belirli kayıtların sınırlı bir süre daha muhafaza edilebileceğini kabul eder.
24. Moderasyon Yetkisi
UNIONION, Platform'un güvenliğini sağlamak, Kullanım Koşulları'nı ve Topluluk Kuralları'nı uygulamak, hukuki yükümlülüklerini yerine getirmek veya diğer Kullanıcıların haklarını korumak amacıyla Kullanıcı İçeriklerini inceleyebilir.
gerekli gördüğü diğer teknik veya idari tedbirleri uygulayabilir.
UNIONION'un moderasyon faaliyetleri, Platform üzerinde yayımlanan her İçeriğin önceden incelendiği, doğrulandığı veya onaylandığı anlamına gelmez.
UNIONION'un herhangi bir İçeriğe müdahale etmemiş olması, söz konusu İçeriğin hukuka uygun olduğu veya UNIONION tarafından benimsendiği şeklinde yorumlanamaz.
25. Fikri Mülkiyet Hakları
Platform, Hizmetler, yazılım, tasarım, kullanıcı arayüzü, algoritmalar, veri tabanları, görseller, markalar, logolar, metinler, grafikler, kodlar ve diğer tüm unsurlar üzerindeki fikri mülkiyet hakları, aksi açıkça belirtilmedikçe UNIONION veya lisans verenlerine aittir.
İşbu Kullanım Koşulları kapsamında Kullanıcıya yalnızca Platform'u kişisel amaçlarla kullanabilmesi için sınırlı, geri alınabilir, münhasır olmayan ve devredilemez bir kullanım hakkı tanınmaktadır.
Bu Kullanım Koşulları kapsamında, fikri mülkiyet haklarının devredildiği veya Kullanıcı lehine herhangi bir ayni ya da mali hak tesis edildiği şeklinde yorum yapılamaz.
26. Yasaklanan Fikri Mülkiyet Kullanımları
Kullanıcı, UNIONION'un önceden yazılı izni bulunmadıkça; Platform'u veya herhangi bir bölümünü kopyalayamaz, çoğaltamaz, değiştiremez, türev eser oluşturamaz, satamaz, kiralayamaz, lisanslayamaz, ticari olarak kullanamaz, yeniden yayımlayamaz, dağıtamaz, tersine mühendislik yapamaz, kaynak koduna erişmeye çalışamaz, Platform'un güvenlik mekanizmalarını aşmaya çalışamaz.
Kullanıcı, Platform üzerinden elde ettiği veri veya içerikleri otomatik yöntemlerle toplamayacağını veya bunları yapay zekâ modellerinin eğitimi, veri madenciliği ya da benzeri amaçlarla kullanmayacağını kabul eder.
27. Geri Bildirim
Kullanıcı, Platform'un geliştirilmesine ilişkin öneri, fikir, hata bildirimi, yorum veya diğer geri bildirimleri UNIONION ile paylaşabilir.
Kullanıcı, bu tür geri bildirimlerin gönüllü olarak sağlandığını ve aksi yazılı olarak kararlaştırılmadıkça UNIONION'un söz konusu geri bildirimleri herhangi bir ücret ödeme yükümlülüğü olmaksızın kullanabileceğini, geliştirebileceğini ve bunlardan yararlanabileceğini kabul eder.
Bu hüküm, Kullanıcının kişisel verileri veya Kullanıcı İçeriği üzerindeki haklarını etkilemez.
28. Fikri Mülkiyet İhlali Bildirimleri
Bir kişinin Platform'da yer alan herhangi bir İçeriğin fikri mülkiyet haklarını ihlal ettiğini düşünmesi hâlinde, UNIONION'a gerekli bilgi ve belgelerle birlikte bildirimde bulunması mümkündür.
UNIONION, uygun gördüğü hâllerde ilgili İçeriği inceleyebilir, geçici olarak erişime kapatabilir veya kaldırabilir.
Tekrarlayan fikri mülkiyet ihlallerinde bulunan Kullanıcıların Hesapları askıya alınabilir veya kalıcı olarak kapatılabilir.
29. Premium Hizmetler
Platform'un belirli özellikleri ücretsiz olarak sunulurken, bazı özellikler yalnızca Premium Hizmetler kapsamında kullanılabilir. Premium Hizmetlerin kapsamı, ücretleri, avantajları, kullanım süreleri ve teknik özellikleri Platform üzerinde ayrıca belirtilir.
UNIONION, Premium Hizmetlerin kapsamını, özelliklerini, içeriklerini ve fiyatlandırmasını zaman zaman güncelleyebilir, değiştirebilir veya sonlandırabilir. Bu değişiklikler, yürürlükteki mevzuat saklı kalmak kaydıyla, geleceğe yönelik olarak uygulanır.
30. Abonelikler
Premium Hizmetler belirli süreli abonelik modeliyle sunulabilir.
yıllık
veya Platform üzerinde belirtilen diğer süreler için sunulabilir.
Aboneliğin kapsamı, başlangıç tarihi, yenileme koşulları ve ücret bilgileri satın alma işlemi sırasında Kullanıcıya gösterilir.
31. Ücretler
Premium Hizmetlere ilişkin ücretler, Platform'da veya ilgili uygulama mağazasında satın alma işlemi tamamlanmadan önce Kullanıcıya bildirilir.
Aksi açıkça belirtilmedikçe; vergiler, işlem ücretleri, uygulama mağazası tarafından tahsil edilen bedeller, ödeme kuruluşlarından kaynaklanan masraflar ilgili satın alma ekranında gösterilen esaslara göre uygulanır.
Kullanıcı, Premium Hizmetleri satın alırken geçerli ücretleri ödemeyi kabul eder.
32. Ödeme Hizmetleri

aracılığıyla gerçekleştirilebilir.
Ödeme işlemleri ilgili ödeme hizmeti sağlayıcısının kendi sözleşme ve politikalarına tabidir.
UNIONION, ödeme hizmeti sağlayıcılarının faaliyetlerinden, sistem kesintilerinden veya ödeme süreçlerinden kaynaklanan gecikmelerden sorumlu değildir.
33. Otomatik Yenilenen Abonelikler
Belirli Premium Hizmetler otomatik yenilenen abonelik modeliyle sunulabilir.
Böyle bir durumda; aboneliğin otomatik yenileneceği, yenileme dönemleri, uygulanacak ücret, iptal yöntemleri satın alma işlemi tamamlanmadan önce Kullanıcıya gösterilir.
Kullanıcı, otomatik yenileme özelliğini dilediği zaman ilgili uygulama mağazasındaki veya ödeme sağlayıcısındaki hesap ayarları üzerinden kapatabilir.
Otomatik yenilemenin kapatılması, ilgili abonelik döneminin sona ermesine kadar Premium Hizmetlerden yararlanılmasını engellemez.
34. Uygulama Marketleri Üzerinden Yapılan Satın Almalar
Uygulama marketleri üzerinden gerçekleştirilen satın alma işlemleri bakımından; ödeme, abonelik yönetimi, otomatik yenileme, iptal, faturalandırma, geri ödeme süreçleri öncelikle ilgili uygulama mağazasının kendi hüküm ve koşullarına tabidir.
UNIONION, uygulama mağazalarının ödeme süreçlerini yönetmemekte olup, ödeme işlemlerine ilişkin teknik veya finansal kararlar üzerinde kontrol sahibi değildir.
35. İadeler
Premium Hizmetlere ilişkin ücret iadeleri; yürürlükteki emredici mevzuat, ilgili uygulama mağazasının politikaları, satın alma işleminin gerçekleştirildiği ödeme hizmeti sağlayıcısının kuralları çerçevesinde değerlendirilir.
İlgili mevzuatın zorunlu kıldığı hâller saklı kalmak üzere, Kullanıcının Premium Hizmetlerden yararlanmaya başlamış olması, yalnızca kişisel tercih değişikliği nedeniyle ücret iadesi talep etme hakkı doğurmaz.
Uygulama marketleri üzerinden gerçekleştirilen satın alma işlemlerine ilişkin iade talepleri, ilgili uygulama mağazasının belirlediği usuller çerçevesinde yürütülebilir.
36. Promosyonlar ve Kampanyalar
UNIONION, zaman zaman; promosyonlar, ücretsiz deneme süreleri, indirim kampanyaları, davet programları, promosyon kodları, sadakat programları sunabilir.
Bu kampanyalar belirli süre, bölge, kullanıcı grubu veya diğer koşullarla sınırlandırılabilir. UNIONION, açıkça aksi belirtilmedikçe herhangi bir kampanyayı sürdürmekle yükümlü değildir.
37. Ücretsiz Deneme
UNIONION, belirli Premium Hizmetler bakımından ücretsiz deneme süresi sunabilir.
herhangi bir zamanda sona erdirilebilir.
Kullanıcının aynı ücretsiz deneme kampanyasından birden fazla kez yararlanmasına izin verilmeyebilir.
38. Vergiler
Kullanıcı, yürürlükteki mevzuat uyarınca Premium Hizmetlerin satın alınması nedeniyle doğabilecek vergi, resim, harç veya benzeri mali yükümlülüklerin ilgili mevzuat kapsamında kendisine ait olabileceğini kabul eder.
UNIONION, uygulanabilir vergi mevzuatı kapsamında tahsil etmekle yükümlü olduğu vergileri ilgili satın alma işlemi sırasında tahsil edebilir.
39. Premium Hizmetlerde Değişiklik
UNIONION; Premium Hizmetlerin kapsamını, teknik özelliklerini, kullanım limitlerini, fiyatlarını, erişim şartlarını geleceğe etkili olacak şekilde değiştirebilir.
Devam eden abonelikler bakımından uygulanacak esaslar, yürürlükteki mevzuat ile satın alma sırasında bildirilen koşullar çerçevesinde belirlenir.
Premium Hizmetlerde yapılan güncellemeler, Platform'un geliştirilmesi veya güvenliğinin sağlanması amacıyla teknik değişiklikler içerebilir.
40. Platform Moderasyonu
UNIONION, Platform'un güvenli, saygılı ve hukuka uygun şekilde işletilebilmesi amacıyla Kullanıcı faaliyetlerini, Kullanıcı İçeriklerini ve Platform kullanımını işbu Kullanım Koşulları, Topluluk Kuralları ve Uygulanabilir Mevzuat çerçevesinde değerlendirebilir.
Bu kapsamda UNIONION; otomatik sistemlerden, yapay zekâ destekli araçlardan, manuel inceleme süreçlerinden, kullanıcı bildirimlerinden, üçüncü kişilerden gelen ihbarlardan, güvenlik analizlerinden yararlanabilir.
UNIONION, moderasyon faaliyetlerini yürütürken Platform'un güvenliği, diğer Kullanıcıların hakları, hukuki yükümlülükleri ve olayın somut özelliklerini dikkate alır.
41. Uygulanabilecek Tedbirler
UNIONION, bir Kullanıcının işbu Kullanım Koşulları'nı, Topluluk Kuralları'nı veya Uygulanabilir Mevzuat'ı ihlal ettiğini makul şekilde değerlendirmesi hâlinde, ihlalin niteliği ve ağırlığı dikkate alınarak aşağıdaki tedbirlerden birini veya birkaçını uygulayabilir:
i) Uygulanabilir Mevzuat kapsamında gerekli görülen diğer tedbirleri uygulamak.
UNIONION, her ihlal bakımından aynı yaptırımı uygulamakla yükümlü değildir.
42. Derhâl Müdahale Gerektiren Durumlar
Aşağıdaki hâllerde UNIONION, önceden bildirimde bulunmaksızın derhâl müdahalede bulunabilir:
gecikmesinde sakınca bulunan diğer hâller.
Bu gibi durumlarda UNIONION, gerekli gördüğü takdirde ilgili İçerikleri kaldırabilir, Hesabı askıya alabilir veya kalıcı olarak kapatabilir.
43. Kullanıcı Bildirimleri ve Şikâyetler
Kullanıcılar, Platform üzerinde yer alan İçerikleri veya diğer Kullanıcıları Platform tarafından sunulan araçlar üzerinden bildirebilir.
UNIONION, yapılan her bildirimin haklı olduğu yönünde garanti vermediği gibi, her bildirimin yaptırım uygulanmasıyla sonuçlanacağını da taahhüt etmez.
Kötü niyetli, asılsız veya sistematik şekilde yapılan bildirimler de Kullanım Koşulları'nın ihlali olarak değerlendirilebilir.
44. Hizmetlerin Değiştirilmesi
UNIONION, Platform'u geliştirmek, güvenliği artırmak, teknik gereklilikleri karşılamak veya ticari ihtiyaçlar doğrultusunda; yeni özellikler ekleyebilir, mevcut özellikleri değiştirebilir, belirli özellikleri kaldırabilir, kullanım limitlerini değiştirebilir, belirli hizmetleri sonlandırabilir.
Bu değişiklikler yürürlükteki mevzuat saklı kalmak kaydıyla geleceğe etkili olarak uygulanır.
45. Hizmetlerin Askıya Alınması
UNIONION; bakım çalışmaları, güvenlik güncellemeleri, teknik arızalar, üçüncü taraf sistemlerinde yaşanan kesintiler, siber saldırılar, altyapı çalışmaları, mücbir sebep hâlleri, hukuki yükümlülüklerin yerine getirilmesi gibi nedenlerle Platform'un tamamını veya belirli bölümlerini geçici olarak askıya alabilir.
UNIONION, planlı kesintiler konusunda teknik olarak mümkün olduğu ölçüde önceden bilgilendirme yapmaya gayret eder.
46. Hizmetlerin Sonlandırılması
UNIONION, belirli bir Hizmeti veya Platform'un tamamını sürekli olarak sonlandırmaya karar verebilir.
Teknik olarak mümkün olduğu ve Uygulanabilir Mevzuat'ın izin verdiği ölçüde, Kullanıcılara makul süre önce bildirim yapılır.
Bu hüküm, yürürlükteki tüketici mevzuatından doğan hakları ortadan kaldırmaz.
47. Kolluk Kuvvetleri ve Yetkili Makamlarla İş Birliği
UNIONION, Uygulanabilir Mevzuat kapsamında; mahkemeler, savcılıklar, kolluk kuvvetleri, düzenleyici ve denetleyici kurumlar, diğer yetkili kamu makamları tarafından usulüne uygun şekilde iletilen talepleri değerlendirebilir ve hukuken gerekli olduğu ölçüde bilgi, belge veya kayıt paylaşabilir.
UNIONION, Platform'un güvenliğini sağlamak veya hukuki yükümlülüklerini yerine getirmek amacıyla gerekli gördüğü durumlarda yetkili makamlarla iş birliği yapabilir.
48. İtiraz ve Yeniden İnceleme
Kullanıcı, Hesabına veya İçeriğine ilişkin uygulanan yaptırımın hatalı olduğunu düşünmesi hâlinde, Platform tarafından sunulan iletişim kanalları aracılığıyla yeniden inceleme talebinde bulunabilir.
UNIONION, yeniden inceleme taleplerini makul süre içerisinde değerlendirmeye çalışır. Yeniden inceleme sürecinin işletilmesi, yaptırımın otomatik olarak kaldırılacağı anlamına gelmez.
49. Gizlilik ve Kişisel Verilerin Korunması
UNIONION, Kullanıcılara ait kişisel verileri yürürlükte bulunan kişisel verilerin korunmasına ilişkin mevzuata ve Platform'da yayımlanan Gizlilik Politikası'na uygun olarak işler.
Kişisel verilerin işlenmesine ilişkin esaslar, veri işleme amaçları, hukuki sebepler, saklama süreleri, kullanıcı hakları ve diğer hususlar Gizlilik Politikası'nda ayrıntılı olarak düzenlenmektedir.
İşbu Kullanım Koşulları ile Gizlilik Politikası birlikte değerlendirilir.
50. Üçüncü Taraf Hizmetleri
Platform, üçüncü taraflara ait internet sitelerine, uygulamalara, ödeme hizmetlerine veya diğer dijital hizmetlere bağlantılar veya entegrasyonlar içerebilir.
UNIONION, üçüncü taraf hizmet sağlayıcılarının içerikleri, güvenliği, gizlilik uygulamaları, hizmet sürekliliği veya hukuka uygunluğu üzerinde kontrol sahibi değildir.
Kullanıcının üçüncü taraf hizmetlerini kullanması, ilgili hizmet sağlayıcısının kendi hüküm ve koşullarına tabidir.
51. Hizmetin Sunumu Hakkında Beyan
Platform, teknik imkânlar, güvenlik gereklilikleri ve hizmetin niteliği çerçevesinde sunulmaktadır.

Platform'un kullanımı sırasında ortaya çıkabilecek teknik sınırlamalar, internet altyapısından kaynaklanan sorunlar, üçüncü taraf hizmet kesintileri veya Kullanıcının kendi cihazından kaynaklanan problemler nedeniyle oluşabilecek aksaklıklar her zaman önlenemeyebilir.
52. Sorumluluğun Sınırlandırılması
kullanıcılar arasındaki uyuşmazlıklardan kaynaklanan zararlar
bakımından hukuken sorumlu tutulamaz.
Hiçbir hüküm, UNIONION'un kastı veya ağır kusurundan doğan sorumluluğunu ortadan kaldıracak veya sınırlandıracak şekilde yorumlanamaz.
53. Kullanıcının Tazmin Yükümlülüğü
üçüncü kişilerin haklarını
ihlal etmesi nedeniyle UNIONION'un maruz kalacağı doğrudan zararları, makul giderleri ve kesinleşmiş yargı kararları veya idari kararlar uyarınca ödemekle yükümlü olduğu tutarları, ilgili mevzuatın izin verdiği ölçüde tazmin etmeyi kabul eder.
Bu hüküm, Kullanıcının emredici mevzuattan doğan haklarını ortadan kaldıracak şekilde yorumlanamaz.
54. Mücbir Sebep
UNIONION; doğal afet, yangın, deprem, sel, savaş, terör olayları, salgın hastalık, grev, lokavt, enerji kesintileri, internet veya elektronik haberleşme altyapısındaki yaygın arızalar, siber saldırılar, kamu otoritelerinin kararları, üçüncü taraf altyapı sağlayıcılarından kaynaklanan olağanüstü kesintiler gibi makul kontrolü dışında gelişen olaylar nedeniyle yükümlülüklerini yerine getirememesinden sorumlu tutulamaz.
Mücbir sebep hâlinin etkileri ortadan kalktığında, UNIONION hizmetlerini makul süre içerisinde yeniden sunmak için gerekli çalışmaları yürütür.
55. Devir
UNIONION, işbu Kullanım Koşulları kapsamındaki hak ve yükümlülüklerini, şirket birleşmesi, bölünmesi, yeniden yapılandırılması, hisse devri, işletme devri veya benzeri ticari işlemler kapsamında, yürürlükteki mevzuata uygun olmak kaydıyla devredebilir.
Kullanıcı ise, UNIONION'un önceden yazılı onayı bulunmadıkça işbu Kullanım Koşulları'ndan doğan hak ve yükümlülüklerini üçüncü kişilere devredemez.
56. Bölünebilirlik
İşbu Kullanım Koşulları'nın herhangi bir hükmünün geçersiz, hükümsüz veya uygulanamaz olduğunun yetkili bir merci tarafından tespit edilmesi hâlinde, söz konusu hüküm yalnızca geçersizlik ölçüsünde etkilenir.
Diğer hükümlerin geçerliliği ve uygulanabilirliği bundan etkilenmez.
57. Feragat Sayılmama
UNIONION'un işbu Kullanım Koşulları kapsamındaki herhangi bir hakkını kullanmaması veya gecikmeli kullanması, söz konusu haktan feragat ettiği şeklinde yorumlanamaz.
Tek seferlik bir uygulama veya istisna, benzer durumlarda aynı şekilde hareket edilmesi gerektiği anlamına gelmez.
58. Bütünlük
Platform üzerinde açıkça atıf yapılan diğer politika ve kurallar
ile birlikte Kullanıcı ile UNIONION arasındaki sözleşmenin tamamını oluşturur.
59. Kullanım Koşullarında Değişiklik
UNIONION, işbu Kullanım Koşulları'nı zaman zaman güncelleyebilir.
Esaslı değişiklikler, yürürlükteki mevzuatın gerektirdiği hâllerde Kullanıcılara uygun iletişim kanalları aracılığıyla bildirilebilir.
Değişikliklerin yürürlüğe girmesinden sonra Platform'un kullanılmaya devam edilmesi, emredici mevzuat saklı kalmak kaydıyla güncellenen Kullanım Koşulları'nın kabul edildiği anlamına gelir.
60. Uygulanacak Hukuk ve Uyuşmazlıkların Çözümü
İşbu Kullanım Koşulları, kanunlar ihtilafı kuralları hariç olmak üzere Türkiye Cumhuriyeti hukukuna tabidir.
İşbu Kullanım Koşulları'ndan doğan uyuşmazlıklarda, yürürlükte bulunan emredici mevzuat uyarınca görevli ve yetkili mercilerin yetkisi saklıdır.
Platformu kullanırken yürürlükteki yasalara göre tüketici sıfatıyla hareket etmiyorsanız, işbu Koşullardan kaynaklanan veya bunlarla ilgili her türlü ihtilaf, İstanbul Tahkim Merkezi Tahkim Kuralları uyarınca tahkime tabi olacaktır ve ilgili kurallar çerçevesinde nihai olarak çözüme kavuşturulur.

Uyuşmazlığın esasına Türk hukuku uygulanır.
61. İletişim
Kullanıcı, Platform ile ilgili her türlü talep, bildirim veya soru için Platform üzerinde belirtilen iletişim kanallarını kullanabilir.
UNIONION tarafından yapılacak bildirimler; uygulama içi bildirim, kayıtlı e-posta adresi veya Platform üzerinden sunulan diğer elektronik iletişim yöntemleri aracılığıyla gerçekleştirilebilir.
1. Purpose and Scope
These Terms of Use ("Terms") govern your access to and use of the mobile application, website, software, digital services and all related features (collectively, the "Platform") provided by UNIONION (a sole proprietorship of Merve Alpay Erengül) ("UNIONION", "Company", "we", "us", or "our").
These Terms apply to every individual who accesses the Platform, creates an Account, uses the Platform or otherwise accesses or uses any Services made available through the Platform (each, a "User" or “you”).
By accessing or using the Platform, you enter into a legally binding agreement with UNIONION.
Please read these Terms carefully before accessing or using the Platform.
By accessing or using the Platform, you acknowledge that you have read, understood and agree to be bound by:
our Community Guidelines; and
any other policies or guidelines that may be published on the Platform from time to time.
If you do not agree to these Terms, you must not access or use the Platform.
2. Definitions
For purposes of these Terms, the following capitalized terms shall have the meanings set forth below.
Account means the personal user account created by a User for the purpose of accessing and using the Services.
Content means any text, message, photograph, video, audio recording, profile information, biography, username, image, emoji, comment, reaction, or any other digital content or information created, uploaded, transmitted or made available through the Platform.
User Content means any Content that is created, uploaded, submitted, transmitted or otherwise made available by a User through the Platform.
Services means all free or paid products, features, subscriptions, matching services, communication tools, AI-powered functionalities and any other services currently available or made available through the Platform in the future.
Premium Services means any subscription-based services, paid digital features or other paid products offered through the Platform.
Community Guidelines means the rules governing acceptable conduct and prohibited activities on the Platform.
Privacy Policy means UNIONION's privacy policy describing how personal data is collected, used, processed and protected.
Applicable Laws means all applicable laws, regulations, statutory instruments, judicial decisions, regulatory requirements and legally binding governmental or administrative measures applicable to the operation or use of the Platform.
3. Acceptance of These Terms
By accessing the Platform, creating an Account or otherwise using the Platform, you agree to be legally bound by these Terms.
Certain Services may be subject to additional terms, policies or conditions. Where additional terms apply, such terms shall govern your use of the relevant Service to the extent of any inconsistency with these Terms.
Access to certain features of the Platform may also require compliance with the terms and conditions of third-party providers, including device manufacturers, application marketplaces, payment service providers or other service providers. By using such third-party services, you acknowledge that your use is subject to the applicable terms of those third parties.
4. Nature of the Platform
UNIONION is a technology platform that enables Users to communicate, interact and access various features and Services made available through the Platform.
UNIONION does not act on behalf of any User; act as an agent, representative, intermediary or guarantor for any User; or become a party to any friendship, social relationship, romantic relationship, commercial relationship or any other interaction established between Users.
The Platform merely provides the technological infrastructure that enables Users to discover, connect and communicate with one another.
UNIONION does not guarantee:
that any romantic, social or commercial relationship will be established; or
that any User will meet another User's expectations.
All communications conducted through the Platform, as well as any meetings, interactions or transactions taking place outside the Platform, are solely the responsibility of the Users involved.
5. Eligibility and Access to the Platform
The Platform may only be used by individuals who have the legal capacity to enter into binding agreements under Applicable Laws.
Unless expressly stated otherwise, you must be at least eighteen (18) years of age to access or use the Platform.
By using the Platform, you represent and warrant that:
d) you have not previously been permanently prohibited from using the Platform; and
e) you will comply with these Terms at all times.
Where UNIONION reasonably determines that these eligibility requirements are not satisfied, or has reasonable grounds to believe that they are not satisfied, UNIONION may suspend your Account, request additional verification or permanently terminate your Account without incurring any liability.
6. Changes to These Terms
UNIONION may amend or update these Terms from time to time. Where changes materially affect Users' rights or obligations, UNIONION will, where reasonably practicable, provide notice through the Platform or by using the contact information associated with your Account before such changes become effective.
Your continued access to or use of the Platform after the effective date of the updated Terms constitutes your acceptance of the revised Terms.
If you do not agree to the updated Terms, you must discontinue your use of the Platform and, if you wish, close your Account.
7. Account Registration
Access to certain features of the Platform requires the creation of an Account.
When creating an Account, you must provide accurate, complete and up-to-date information as requested by UNIONION. You agree that you will not create an Account using information that is false; misleading; outdated; belonging to another person; or otherwise inaccurate or fraudulent.
UNIONION is not obligated to verify the accuracy of the information you provide. However, UNIONION reserves the right to request additional information or documentation, or to implement verification procedures whenever it considers such measures necessary.
You acknowledge that failure to complete any requested verification process within a reasonable period may result in restricted access to some or all of the Services.
8. Account Security
You are solely responsible for maintaining the confidentiality and security of your Account credentials, including your username, password, verification codes and any other authentication information associated with your Account.
You agree that you will:
keep your login credentials confidential;
not permit any third party to access or use your Account; and
promptly notify UNIONION if you become aware of any unauthorized access to or use of your Account.
Unless proven otherwise, any activity carried out through your Account shall be deemed to have been performed by you.
UNIONION shall not be responsible for any loss, damage or unauthorized use resulting from your failure to comply with your Account security obligations.
9. One Account Policy
Unless expressly authorized by UNIONION, each individual may maintain only one (1) active Account on the Platform.
Where UNIONION reasonably determines that multiple Accounts are operated by the same individual—including, without limitation, Accounts associated with identical identity information, contact details, devices or other technical indicators—UNIONION may investigate, merge, suspend or permanently terminate such Accounts.
This policy is intended to prevent abuse of the Platform, maintain Platform integrity and protect other Users.
10. Identity and Profile Verification
To enhance the safety and integrity of the Platform, UNIONION may implement various verification procedures.
Such verification methods may include, without limitation: email verification; mobile phone verification; AI-assisted detection of fake or fraudulent profiles; and verification services provided by trusted third-party providers.
Completion of any verification process does not constitute a guarantee by UNIONION regarding a User's identity, authenticity, trustworthiness, intentions or future conduct.
A verified badge or similar designation merely indicates that the applicable verification process has been completed successfully.
UNIONION reserves the right to introduce, modify, discontinue or require any verification method for specific Users, regions or Services at its sole discretion.
11. Profile Information
You are responsible for ensuring that all information displayed on your profile is accurate, truthful and kept reasonably up to date.
You may not: impersonate another individual; use another person's photographs or other identifying materials without authorization; create a misleading or deceptive identity; or misrepresent qualifications, affiliations or other profile information in a manner that is likely to mislead other Users.
Profile photographs, biographies, usernames and all other profile elements must comply with these Terms and the Community Guidelines.
Where UNIONION reasonably determines that any profile information is inappropriate or non-compliant, UNIONION may require you to update such information, restrict its visibility or remove it from the Platform.
12. Personal Nature of the Account
Your Account is personal to you. You may not: sell; assign; transfer; license; lease; share; or otherwise make your Account available to any third party.
Any attempted transfer of an Account without UNIONION's prior written consent shall be null and void.
13. Suspension and Termination of Accounts
Where UNIONION reasonably determines that you have violated: (i) these Terms; (ii) the Community Guidelines; or (iii) any Applicable Laws, or where such action is necessary to protect the Platform, other Users or to comply with legal obligations, UNIONION may, with or without prior notice where appropriate:
block specific devices or IP addresses; and/or
prevent the creation of new Accounts.
UNIONION shall determine the appropriate enforcement action based on the nature, seriousness and circumstances of each case.
14. Account Closure by the User
You may close your Account at any time through the Platform or by using any other method made available by UNIONION.
Closing your Account does not automatically terminate or affect: obligations arising under Applicable Laws; provisions relating to active subscriptions; intellectual property licenses granted under these Terms; dispute resolution provisions; or provisions concerning limitations of liability.
UNIONION may retain certain information and records for the period required or permitted under Applicable Laws, including where necessary to comply with legal obligations, resolve disputes, enforce these Terms or protect UNIONION's legitimate interests.
15. Use of the Platform
You agree to use the Platform solely for lawful purposes and in accordance with these Terms, the Community Guidelines and all Applicable Laws.
The purpose of the Platform is to enable Users to connect, communicate and interact with one another through the features and Services made available by UNIONION.
The Platform may not be used for any unlawful purpose, to cause harm to others, to harass or disrupt other Users, or to compromise the security, integrity or proper functioning of the Platform.
You further agree to use the Platform in good faith, in a respectful manner and with due regard for the rights and legitimate interests of other Users.
16. User Responsibilities
When using the Platform, you agree to comply with: (i) all Applicable Laws; (ii) these Terms; (iii) the Community Guidelines; and (iv) the rights of other individuals and third parties.
You acknowledge and agree that you are solely responsible for:
your meetings, interactions and activities outside the Platform; and
all activities conducted through your Account.
17. Prohibited Conduct
You agree that you will not engage in any of the following activities while using the Platform.
17.1 Identity and Trust Violations
You may not:
falsely represent yourself as a verified User; or
access or use another person's Account.
17.2 Unlawful Activities
You may not use the Platform to:
evade applicable sanctions or regulatory restrictions; or
engage in any activity that violates Applicable Laws.
17.3 Harassment and Harmful Conduct
You may not engage in conduct that is:
sexually harassing; or
otherwise intended to intimidate, distress or harm another User.
Continuing to contact another User after they have clearly expressed that they no longer wish to communicate may also constitute a violation of this Section.
17.4 Deceptive and Manipulative Conduct
You may not:
promote multi-level marketing (MLM), pyramid schemes or similar programs; or
direct Users to fraudulent or deceptive activities outside the Platform.
17.5 Commercial Use
Unless expressly authorized in writing by UNIONION, you may not use the Platform for commercial purposes, including but not limited to advertising; marketing; promoting products or services; customer acquisition; sponsorship activities; commercial campaigns; generating traffic to third-party platforms; or building audiences for commercial gain.
17.6 Platform Integrity and Security
You may not circumvent or attempt to circumvent any security measures implemented by UNIONION; access or attempt to access the source code of the Platform; reverse engineer, decompile or disassemble any part of the Platform; scrape, harvest or extract data through automated means; use bots, crawlers, spiders or similar technologies; interfere with or disrupt the normal operation of the Platform; introduce malicious code, malware or viruses; exploit security vulnerabilities; or engage in denial-of-service (DoS), distributed denial-of-service (DDoS) or similar attacks.
17.7 Automated Use
Unless expressly authorized in writing by UNIONION, you may not use AI agents; automated software; bots; automated messaging systems; automated profile creation tools; or any similar automated technologies to access or interact with the Platform.
18. Communication and Interaction Between Users
Communications and interactions facilitated through the Platform occur solely between the Users involved.
UNIONION does not verify or guarantee the accuracy of Users' statements; identity of any User; intentions of any User; trustworthiness of any User; conduct of any User; or actions that any User may take outside the Platform.
Users will be able to communicate and interact with one another via the direct messaging (DM) channel, the features and functions of which may be subject to change and update from time to time at UNIONION’s discretion. Direct messages are also subject to these Terms of Use and the various policies and procedures adopted by UNIONION. Users are obliged to behave in accordance with the rules of conduct and ethics adopted by UNIONION, in particular the Community Guidelines. Items sent via direct messaging are also considered to be Content and are subject to the rules specific to Content.
You are solely responsible for exercising appropriate judgment and caution when communicating with or meeting other Users, whether through or outside the Platform.
UNIONION shall not be responsible for any disputes, losses, injuries or damages arising out of interactions between Users outside the Platform.
19. Reporting and Moderation
To help maintain a safe and respectful environment, Users may report other Users or Content through the reporting tools made available on the Platform.
UNIONION may review reports; request additional information; evaluate and monitor reported Content; investigate Accounts; and take any enforcement measures it considers appropriate under these Terms.
UNIONION's moderation activities are intended to promote the safety and integrity of the Platform. However, UNIONION does not guarantee that all Content is reviewed before publication or continuously monitored.
The existence of reporting mechanisms or moderation procedures does not constitute a guarantee that unlawful, inappropriate or undesirable conduct will be detected or prevented.
20. Community Guidelines
In addition to complying with these Terms, all Users are required to comply with the Community Guidelines in order to help maintain a safe, respectful and trustworthy environment on the Platform.
The Community Guidelines form an integral part of these Terms and establish the standards of acceptable conduct expected from all Users.
A violation of the Community Guidelines may result in one or more enforcement actions, depending on the nature and severity of the violation, including:
permanent termination of an Account; or
restrictions on creating new Accounts.
UNIONION reserves the right to determine the appropriate enforcement action after considering the nature of the violation, its severity, whether it is repeated, and its potential impact on other Users and the Platform.
21. User Content
The Platform may enable Users to create profiles, upload photographs, exchange messages, post comments and otherwise interact with other Users.
Any Content that you create, upload, submit, transmit or otherwise make available through the Platform shall, unless expressly stated otherwise, be deemed User Content.
You acknowledge and agree that you are solely responsible for all User Content that you create, upload, publish or otherwise make available through the Platform.
UNIONION does not endorse, verify or guarantee the accuracy, legality, completeness or reliability of any User Content.
22. User Representations and Warranties
By uploading or making any User Content available through the Platform, you represent and warrant that:
your User Content does not infringe or violate any intellectual property rights, privacy rights, publicity rights or any other rights of any third party;
your User Content complies with all Applicable Laws; and
your User Content complies with these Terms and the Community Guidelines.
You further agree that you will not upload photographs, videos, audio recordings or any other materials belonging to another person without obtaining all necessary rights, permissions or authorizations.
23. License Granted to UNIONION
You retain ownership of your User Content.
However, by submitting or making User Content available through the Platform, you grant UNIONION a worldwide, non-exclusive, transferable, sublicensable, royalty-free license, for the duration necessary to operate and provide the Platform and the Services, to use such User Content solely for purposes related to the operation of the Platform.
This license includes the right to:
analyze for safety and security purposes; and
perform any other technical processing reasonably necessary to operate, maintain and improve the Platform and the Services.
This license does not authorize UNIONION to use your User Content for advertising, marketing or commercial purposes outside the operation of the Platform unless you have separately provided your explicit permission where required.
You acknowledge that, even after deleting your Account or removing your User Content, certain copies may remain in backup systems or may be retained for a limited period where required for technical, legal, regulatory or legitimate business purposes.
24. Content Moderation
UNIONION may review User Content in order to maintain the safety and integrity of the Platform; enforce these Terms and the Community Guidelines; comply with Applicable Laws; or protect the rights, safety and legitimate interests of Users and third parties.
For these purposes, UNIONION may:
investigate Accounts; and
implement any other technical or administrative measures reasonably considered necessary.
UNIONION's moderation activities do not imply that all User Content is reviewed, monitored or approved before being made available on the Platform.
Likewise, UNIONION's decision not to remove or restrict any particular Content shall not be interpreted as an endorsement of, or approval of, such Content.
25. Intellectual Property Rights
Unless expressly stated otherwise, all intellectual property rights in and to the Platform, including its software, source code, user interface, design, algorithms, databases, trademarks, logos, graphics, text and all other materials made available through the Platform, are owned by or licensed to UNIONION.
Subject to your compliance with these Terms, UNIONION grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable license to access and use the Platform solely for your personal, non-commercial use.
Nothing in these Terms shall be construed as transferring or assigning any intellectual property rights to you.
26. Restrictions on Use of UNIONION's Intellectual Property
Except as expressly permitted by these Terms or with UNIONION's prior written consent, you may not copy; reproduce; modify; adapt; create derivative works from; distribute; publish; sell; license; lease; commercially exploit; reverse engineer; decompile; disassemble; or otherwise attempt to derive the source code of any part of the Platform or any intellectual property owned or licensed by UNIONION.
You further agree not to collect, extract or use any data, Content or information obtained through the Platform for the purpose of training artificial intelligence models, machine learning systems, large language models, data mining activities or any similar technologies without UNIONION's prior written authorization.
27. Feedback
You may voluntarily submit suggestions, comments, ideas, feature requests, bug reports or other feedback regarding the Platform or the Services ("Feedback").
Unless otherwise agreed in writing, you acknowledge and agree that UNIONION may use, modify, implement, reproduce and otherwise exploit such Feedback without restriction and without any obligation to compensate you.
Nothing in this Section affects your ownership of your User Content or your rights relating to personal data.
28. Intellectual Property Complaints
If you believe that any Content available through the Platform infringes your intellectual property rights, you may submit a notice to UNIONION together with sufficient supporting information and documentation.
Upon receipt of such notice, UNIONION may investigate the matter and, where appropriate, temporarily restrict access to or remove the allegedly infringing Content.
Users who repeatedly infringe the intellectual property rights of others may have their Accounts suspended or permanently terminated.
29. Premium Services
While certain features of the Platform are available free of charge, access to certain features may require the purchase of Premium Services.
The scope, features, pricing, duration and availability of Premium Services will be described on the Platform.
UNIONION reserves the right to modify, update or discontinue any Premium Services, including their features, pricing or availability, from time to time. Any such changes shall apply prospectively and shall be subject to Applicable Laws.
30. Subscriptions
Premium Services may be offered on a subscription basis.
Subscriptions may be available for:
annual; or
any other subscription periods made available on the Platform.
The applicable subscription period, commencement date, renewal terms and pricing will be disclosed to you before you complete your purchase.
31. Fees
The applicable fees for Premium Services will be displayed on the Platform or the relevant application marketplace before your purchase is completed.
Unless otherwise expressly stated, any applicable: taxes; transaction fees; charges imposed by application marketplaces; or fees imposed by payment service providers shall be charged in accordance with the terms presented during the purchase process.
By purchasing Premium Services, you agree to pay all applicable fees.
32. Payment Services
Payments for Premium Services may be processed through:
banks or card issuers; or
other third-party payment service providers.
All payment transactions are subject to the applicable terms and conditions of the relevant payment provider.
UNIONION is not responsible for payment processing, payment failures, delays, interruptions or other issues arising from third-party payment providers.
33. Automatically Renewing Subscriptions
Certain Premium Services may be offered as automatically renewing subscriptions.
Where automatic renewal applies, you will be informed before completing your purchase of whether the subscription renews automatically; the applicable renewal period; the renewal price; and how automatic renewal may be cancelled.
You may disable automatic renewal at any time through the account settings of the applicable application marketplace or payment provider.
Disabling automatic renewal will not affect your access to the Premium Services during the remainder of the subscription period that has already been paid for.
34. Purchases Through Application Stores
Where Premium Services are purchased through application stores, matters relating to payment processing; subscription management; automatic renewals; cancellations; billing; and refunds shall primarily be governed by the applicable policies, terms and procedures of the relevant application marketplace.
UNIONION does not administer or control the payment systems operated by Apple, Google or other application marketplaces and has no control over their payment-related decisions or processes.
35. Refunds
Requests for refunds relating to Premium Services shall be handled in accordance with applicable laws; the policies of the relevant application marketplace; and the rules of the payment service provider through which the purchase was made.
Subject to any mandatory rights available under Applicable Laws, your decision not to continue using the Premium Services after access has been granted does not, by itself, entitle you to a refund.
Where purchases are made through Apple App Store or Google Play, refund requests may be submitted through the procedures established by the applicable application marketplace.
36. Promotions and Campaigns
From time to time, UNIONION may offer promotional offers; free trial periods; discounted subscriptions; referral programs; promotional codes; or loyalty or reward programs.
Any such offers may be limited by duration, geographic region, eligibility requirements or other conditions specified by UNIONION. Unless expressly stated otherwise, UNIONION is under no obligation to continue, renew or extend any promotion or campaign.
37. Free Trials
UNIONION may offer free trial access to certain Premium Services.
Free trial offers:
may be limited to specific groups of Users; and
may be modified or discontinued at any time.
UNIONION may also restrict a User from receiving the same free trial offer more than once.
38. Taxes
You acknowledge that the purchase of Premium Services may be subject to taxes, duties or similar governmental charges under Applicable Laws.
Where UNIONION is legally required to collect or remit such taxes, the applicable amounts may be included in or added to the purchase price during the checkout process.
39. Changes to Premium Services
UNIONION may modify the scope of Premium Services; available features; technical specifications; usage limits; pricing; and access requirements from time to time.
Any such modifications shall apply prospectively and in accordance with Applicable Laws and the terms presented at the time of purchase.
UNIONION may also implement technical updates or improvements to Premium Services where necessary to maintain, improve or secure the Platform and the Services.
40. Platform Moderation
To maintain a safe, respectful and legally compliant environment, UNIONION may review User activity, User Content and use of the Platform for the purpose of enforcing these Terms, the Community Guidelines and Applicable Laws.
In carrying out moderation activities, UNIONION may rely on, among other things automated detection systems; artificial intelligence-assisted moderation tools; manual review by authorized personnel; reports submitted by Users; notices received from third parties; and security monitoring and risk assessment systems.
When taking moderation actions, UNIONION may consider the safety of the Platform, the rights and interests of other Users, its legal obligations and the specific circumstances of each case.
41. Enforcement Measures
Where UNIONION reasonably determines that a User has violated these Terms, the Community Guidelines or Applicable Laws, UNIONION may take one or more of the following enforcement measures, taking into account the nature and severity of the violation:
i) prevent the creation of new Accounts by the same individual through reasonable technical measures; or
j) implement any other enforcement measure reasonably necessary to protect the Platform, its Users or comply with Applicable Laws.
UNIONION is not required to apply the same enforcement measure in every case and may determine the appropriate response based on the circumstances of each violation.
42. Immediate Action
UNIONION may take immediate action, including without prior notice where appropriate, in circumstances involving:
compliance with a court order or request from a competent public authority; or
any other circumstances where immediate intervention is reasonably necessary.
In such circumstances, UNIONION may remove Content, suspend or terminate Accounts, restrict access to Services or take any other action reasonably considered necessary.
43. User Reports and Complaints
Users may report Content or other Users through the reporting mechanisms made available on the Platform.
UNIONION will review reports as appropriate; however, UNIONION does not guarantee that every report will result in enforcement action or that every reported violation will be confirmed.
Submitting false, malicious or abusive reports, including repeated reports made in bad faith, may itself constitute a violation of these Terms.
44. Changes to the Services
UNIONION may, from time to time introduce new features; modify existing features; discontinue certain functionalities; adjust usage limits; or retire specific Services, where reasonably necessary for technical, operational, commercial or security reasons.
Any such changes shall apply prospectively and in accordance with Applicable Laws.
45. Suspension of the Services
UNIONION may temporarily suspend all or part of the Platform or the Services for reasons including, without limitation scheduled maintenance; security updates; technical failures; interruptions affecting third-party systems or infrastructure; cyberattacks; infrastructure upgrades; force majeure events; or compliance with legal or regulatory obligations.
Where reasonably practicable, UNIONION will make reasonable efforts to provide advance notice of planned interruptions.
46. Discontinuation of the Services
UNIONION reserves the right to discontinue a particular Service or the Platform as a whole.
Where reasonably practicable and subject to Applicable Laws, UNIONION will provide Users with reasonable prior notice before permanently discontinuing a Service.
Nothing in this Section limits any mandatory rights that Users may have under Applicable Laws.
47. Cooperation with Public Authorities
UNIONION may cooperate with courts, prosecutors, law enforcement agencies, regulatory authorities and other competent public authorities where required or permitted under Applicable Laws.
Where legally required or otherwise permitted by Applicable Laws, UNIONION may disclose information, records or other relevant data in response to valid legal requests or for the purpose of complying with its legal obligations.
UNIONION may also cooperate with competent authorities where reasonably necessary to protect the safety, security and integrity of the Platform or its Users.
48. Appeals and Review
If you believe that an enforcement action affecting your Account or Content has been taken in error, you may request a review through the communication channels made available by UNIONION.
UNIONION will make reasonable efforts to review such requests within a reasonable period of time.
Submitting a request for review does not automatically suspend or reverse the enforcement action while the review is pending.
49. Privacy and Personal Data
UNIONION processes personal data in accordance with applicable data protection laws and the Privacy Policy made available on the Platform.
The Privacy Policy describes, among other things, the categories of personal data processed, the purposes and legal bases for processing, applicable retention periods, Users' rights, and the measures implemented to protect personal data.
These Terms and the Privacy Policy shall be read together and, where applicable, complement one another.
50. Third-Party Services
The Platform may contain links to, or integrations with, third-party websites, applications, payment services or other digital services.
UNIONION does not own or control such third-party services and is not responsible for their content, security, availability, privacy practices or legal compliance.
Your use of any third-party service is governed solely by the applicable terms and policies of the relevant third-party provider.
51. Service Availability Disclaimer
The Platform and the Services are provided using commercially reasonable efforts and subject to technical limitations inherent in online services.
While UNIONION endeavors to provide a reliable and secure Platform, UNIONION does not warrant or guarantee that:
any match will occur; or
use of the Platform will produce any particular outcome.
Interruptions, delays or other service limitations may occur due to internet infrastructure, telecommunications networks, third-party service providers, software updates, maintenance activities or other technical factors beyond UNIONION's reasonable control.
52. Limitation of Liability
To the fullest extent permitted by Applicable Laws, and without limiting any liability that cannot lawfully be excluded or limited, UNIONION shall not be liable for:
disputes between Users; or
losses arising from interactions or meetings occurring outside the Platform.
Nothing in these Terms shall exclude or limit UNIONION's liability for fraud, wilful misconduct, gross negligence or any liability that cannot lawfully be excluded or limited under Applicable Laws.
53. Indemnification
You agree to indemnify, defend and hold harmless UNIONION, its affiliates, directors, officers, employees, contractors and service providers from and against any claims, damages, liabilities, losses, costs and expenses (including reasonable legal fees), arising out of or relating to:
your violation of Applicable Laws; or
your infringement of any third-party rights.
This indemnification obligation shall apply only to the extent permitted under Applicable Laws and shall not limit any mandatory statutory rights available to you.
54. Force Majeure
UNIONION shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from events beyond its reasonable control, including, without limitation natural disasters; fires; earthquakes; floods; wars; acts of terrorism; epidemics or pandemics; strikes or labor disputes; widespread power outages; failures of internet or telecommunications infrastructure; cyberattacks; governmental actions; or extraordinary failures affecting third-party infrastructure providers.
Where a force majeure event occurs, UNIONION will use reasonable efforts to resume the affected Services as soon as reasonably practicable.
55. Assignment
UNIONION may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets or any similar corporate transaction, provided such assignment is made in accordance with Applicable Laws.
You may not assign, transfer or otherwise dispose of any of your rights or obligations under these Terms without UNIONION's prior written consent.
56. Severability
If any provision of these Terms is determined by a court or other competent authority to be invalid, illegal or unenforceable, such provision shall be deemed modified to the minimum extent necessary to make it enforceable or, if modification is not possible, severed from these Terms.
The validity and enforceability of the remaining provisions shall remain unaffected.
57. No Waiver
Failure or delay by UNIONION in exercising any right or remedy under these Terms shall not constitute a waiver of that right or remedy.
Any waiver of a right or remedy shall be effective only if made expressly and shall not be deemed a waiver of any subsequent breach or default.
58. Entire Agreement
These Terms, together with the:
Privacy Policy;
Community Guidelines; and
any other policies or documents expressly incorporated by reference,
constitute the entire agreement between you and UNIONION regarding your access to and use of the Platform and supersede all prior understandings relating to the same subject matter.
59. Changes to These Terms
UNIONION may amend these Terms from time to time.
Where material changes affect Users' rights or obligations, UNIONION will provide notice where required by Applicable Laws or where otherwise reasonably practicable.
Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the updated Terms, subject to any mandatory rights provided under Applicable Laws.
60. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of laws principles.
Any dispute arising out of or relating to these Terms or the use of the Platform shall be subject to the mandatory jurisdiction rules prescribed by Applicable Laws.
If you are not using the Platform as a “consumer” under applicable laws, any dispute arising out of or relating to these Terms may be subject to arbitration under and shall be finally settled through arbitration under the Istanbul Arbitration Centre Arbitration Rules.
The place of the arbitration shall be Istanbul, Türkiye.
The language of the arbitration shall be English.
The law applicable to the merits of the dispute shall be Turkish.
